Rights of Publicity

Nevada Revised Statutes 597.770 – 597.810 contain the provisions for right of publicity in the name, voice, signature, photograph or likeness of every person.

A successor in interest or a licensee of a deceased person may file in the office or the Secretary of State, on a form prescribed by the Secretary of State, a verified application for registration of his claim. A successor in interest or a licensee of a deceased person may not assert any right against any unauthorized commercial use of the deceased person's name, voice, signature, photograph or likeness that begins before the filing of an application to register his claim.

The form is called "Application For Registration Of Claim To Right Of Publicity," must be accompanied by a filing fee is $25 and must be notarized. The application is good for 50 years after the death of the person whose identity is the subject of the claim and there is no renewal of this application.

Currently, this application is filed only in our Las Vegas Satellite office.
